This Privacy Statement explains how Groupon Australia Pty Ltd, its affiliates, and its subsidiaries (“Groupon,” “us,” “our,” and “we”), collect and use your personal information when you, when acting as a merchant or vendor to Groupon, use our websites and platforms – including mobile applications, touch technologies, electronic services, social networking sites, interactive features, online services or any of our described online activities we own or control (collectively, the “Services”) – that link to this Privacy Statement.

We may modify this Privacy Statement at any time. If we make any changes that materially change the ways we process or protect your information, we will provide additional notification of the changes. You can determine when this Privacy Statement was last revised by referring to the "Effective Date” above.

1. TYPES OF INFORMATION WE COLLECT

We may collect the following categories of information from and about you:

  • Identifiers: such as your email address, physical address, phone number, advertising identifiers, device identifiers, IP address, and password for our website or for accessing the Groupon Merchant Center;
  • Commercial Information: such as details about offers, vouchers, and products which you place on the Services for purchase by our customers, including details of how many times these offers were purchased;
  • Internet or other electronic network activity information: such as information about how you interact with the Services, including website browsing preferences, and how you interact with our ads or other content on other pages online (e.g., through cookies and other types of device identifiers);
  • Financial Information: such as your bank details in the event that you enter into a contract with us;
  • Professional or Employment Information: such as your employer or job title; and
  • Other information you actively send to us: such as information you send to us via email or instant messenger chats with our business consultants.

2. HOW WE USE INFORMATION

We use the information we collect in order to:

  • Provide the services we offer as set out in the merchant agreement, including allowing you to place offers, promotions, products and services for purchase on the Services.
  • Operate, maintain, and improve the Services by analyzing how you and our other merchants use the Services;
  • Provide you with access to the Groupon Merchant Center and/or other tools to enable you to better manage certain promotions you run with us and receive information relating to the same;
  • Contact you to discuss existing or potential future commercial agreements;
  • Carry out marketing, which may involve sending you direct marketing messages and other communications that may be of interest to you via email;
  • Answer your questions and respond to your requests, for example in the context of providing services to you;
  • Send you reminders, technical notices, updates, security alerts, support and administrative messages, service bulletins, and other requested information;
  • Manage our everyday business needs, such as administration of the Services, forum management, fulfillment, analytics, fraud prevention, and enforcement of our corporate reporting obligations and Terms of Use; and
  • Comply with our legal obligations, resolve disputes, and enforce our agreements.

3. STORAGE AND PROCESSING

We are committed to maintaining the confidentiality of the information that you provide us and we have implemented an information security program that contains administrative, technical, and physical controls that are designed to reasonably safeguard all personal information.

Data that we collect about you may be stored or otherwise processed by third party services with data centers based outside of Australia. We consider that the collection and such processing of this information is necessary to pursue our legitimate interests in a way that might reasonably be expected and which does not materially impact your rights, freedom or interests.

4. HOW LONG WE RETAIN YOUR PERSONAL INFORMATION

We will retain your personal information where we have an ongoing legitimate business need to do so, or to enable us to meet our legal, tax or accounting obligations.

If you object to us processing certain categories of your personal information (including in relation to receiving marketing communications from us), we will retain a record of your objection to the processing of your information so that we can continue to respect your wishes.

We will destroy or permanently anonymize your personal and financial information at the point that we no longer need to process it for our ongoing legitimate business needs or for any legal, tax or accounting obligation. If this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store it and isolate it from any further processing until deletion is possible.

5. ACCESS TO YOUR PERSONAL INFORMATION

In most cases, you may have access to personal information that we hold about you. We will handle requests for access to your personal information in accordance with the Australian Privacy Principles. All requests for access to your personal information must be directed to the Groupon Privacy Office by email at privacy@groupon.com. We will handle all requests for access to personal information as quickly as possible. Requests for a large amount of information, or information that is not currently in use, may require further time before a response can be given. We may charge you a fee for access if a cost is incurred by us in order to retrieve your information, but in no case will we charge you a fee for your application for access.

In some cases, we may refuse to give you access to personal information that we hold about you. This may include circumstances where giving you access would:

  • be unlawful (eg, where a record that contains personal information about you is subject to a claim for legal professional privilege by one of our contractual counterparties);
  • have an unreasonable impact on another person’s privacy; or
  • prejudice an investigation of unlawful activity.

We may also refuse access where the personal information relates to existing or anticipated legal proceedings, and the information would not be accessible by the process of discovery in those proceedings.

If we refuse to give you access, we will provide you with reasons for our refusal.

If and when you make a request, we will amend any personal information about you that is held by us and that is inaccurate. If we disagree with your view about the accuracy, completeness or currency of a record of your personal information that is held by us, and you ask us to associate with that record a statement that you have a contrary view, we will take all reasonable steps to do so.
